New SAG-AFTRA Deal Addresses AI and Pension Plans

A significant four-year agreement has been forged between SAG-AFTRA and major studios/streamers, addressing critical concerns in the entertainment industry. This landmark deal, made public on a recent Monday, focuses on establishing new safeguards for performers in the age of generative artificial intelligence and unifying the union's pension structures.

At the heart of the new contract are groundbreaking provisions concerning artificial intelligence, which have been a primary focus for the performers' union. The agreement champions human talent, stipulating that producers should prioritize human performances over AI-generated alternatives unless the latter offers substantial additional value to a project. Furthermore, it outlines strict rules for the use of AI-created digital replicas, requiring clear business justification for performer scans and prohibiting their use in contexts that would necessitate an actor's consent or during union strikes. These measures also include minimum payment rates and residuals for the utilization of independently created digital likenesses.

Beyond AI, the deal tackles the long-standing goal of merging SAG-AFTRA's two distinct pension plans, aiming for a unified system by January 1, 2028, with a concurrent 1 percent increase in contribution rates. Compensation for members will see a 3 percent annual rise in minimum wage rates throughout the contract's duration, and the union's health plan contribution rate will also increase by 1 percent starting July 1. Additionally, the agreement recognizes SAG-AFTRA as the exclusive bargaining agent for choreographers and mandates the display of the union's logo in project end credits. Further discussions are planned to re-evaluate confidentiality agreements related to studios' new media licensing.

This comprehensive agreement underscores a proactive approach to protecting artists' rights and securing their future in an evolving industry landscape. By embracing technological advancements while upholding the value of human creativity and ensuring financial stability, the union and studios have laid a foundation for sustainable growth and fair practices. This collaborative effort demonstrates a commitment to adapt to change while honoring the indispensable contributions of performers and creative professionals, fostering a more equitable and promising future for all involved.
